1. Agreement to terms
By engaging Marketing4Leads (operated by SEOwali Digital Services, Ludhiana, India) for any service — web design, SEO, lead generation, or care plans — you agree to these terms. If you don't agree, please don't proceed with the engagement.
2. Our services
We offer:
- Website design and development (one-time projects)
- SEO services and content production (one-time and ongoing)
- Lead generation campaigns (Google Ads, Meta Ads)
- "Sambhal Lo" website care plans (monthly/annual subscriptions)
Specific scope, deliverables, and timeline for your project are documented in your individual quote/proposal.
3. Payment terms
For one-time projects (websites, SEO setup, etc.)
- 50% deposit required before we start work
- 50% balance due before website goes live (or before final deliverables are handed over)
- Accepted methods: Stripe, Razorpay, Wise, bank transfer, UPI, NEFT
- Currencies: CAD, AUD, GBP, USD, INR — quoted upfront, no surprise conversion fees
- All prices are tax-inclusive for our region. International clients are responsible for any local taxes/import duties on services.
For care plans (subscriptions)
- Billed monthly in advance
- 20% discount for annual upfront payment
- Cancel anytime — no contract lock-in
- If cancelled mid-month, current month's fee is non-refundable but no further charges apply
Late payments
- Invoices are due within 7 days of issuance
- After 14 days late: services may be paused (website hosting, SEO work, etc.)
- After 30 days late: account is suspended and may be referred to collections
4. Delivery & timelines
Stated delivery times (e.g., "72 hours", "5 days") begin from the moment we receive both: (a) your 50% deposit, and (b) all required content from you (logo, photos, text, business details).
If you delay providing content, the timeline extends accordingly. We're not responsible for delays caused by missing client inputs.
Each project includes 2 rounds of revisions. Additional revisions are billed at our standard hourly rate (CAD 75/hour).
5. Refund policy
We offer a 7-day money-back guarantee on all one-time website projects, with these conditions:
- Refund request must be submitted within 7 days of website launch
- You must have provided clear feedback and given us at least 2 rounds of revisions to address concerns
- Refunds processed within 14 business days via the original payment method
- If we've already incurred third-party costs (premium plugins, stock photos purchased on your behalf), those are deducted from the refund
Care plans: No refunds for partial months. Cancel anytime to stop future billing.
SEO services: Non-refundable once work has started, since we incur immediate costs (content writing, link building, etc.). However, if we materially fail to deliver agreed scope, we'll work on it until corrected at no extra cost.
6. Ownership & intellectual property
Once final payment is received:
- You own the website, its design, content (you provided), domain, and full source files
- You get full admin access — login credentials, hosting access, etc.
- You can move hosting, switch agencies, or modify the site at any time
We retain the right to:
- Display the website in our portfolio (with your permission)
- Reuse generic code patterns, frameworks, and templates we developed
- Reference the project in case studies (with your permission, no proprietary info shared)
You retain ownership of your business name, logo, brand assets, content you provided, and customer data. We don't claim any of these.
7. Client responsibilities
- Provide accurate business information, content, and assets in a timely manner
- Respond to our questions/feedback requests within reasonable time (usually within 48 hours)
- Ensure you have legal rights to all content (text, images, logos) you provide us
- Pay invoices on time
- Notify us of any issues/bugs within reasonable time post-launch
8. Limitation of liability
We do our best work, but we're human. Specifically:
- We provide services "as is" with reasonable professional skill and care
- We're not liable for losses caused by third-party services we use (hosting downtime, payment processor issues, Google algorithm changes)
- We're not liable for results that depend on factors outside our control (your local market, competitor actions, customer behaviour)
- Our maximum liability for any claim is limited to the total amount you paid us in the previous 6 months
- We're not liable for indirect, consequential, or special damages (lost profits, missed opportunities, etc.)
9. Termination
Either of us can end our relationship:
- For one-time projects: Once work is complete and final payment received, the project is complete. Future engagements are separate.
- For care plans: Either party can cancel with 30 days notice. We'll provide a clean handover (full admin access, recent backup, etc.) within 14 days.
- For breach of terms: If either side materially breaches these terms (e.g., non-payment, abusive behaviour, illegal content), the other can terminate immediately.
10. Governing law
These terms are governed by the laws of India. Any disputes will be resolved in the courts of Ludhiana, Punjab. However, we'll always try to resolve issues amicably first via direct communication.
For international clients, we may agree in your service contract to specific jurisdiction or arbitration clauses appropriate to your location.
These terms apply alongside any specific service agreement (proposal, quote, or contract) we sign for your individual project. In case of conflict between these general terms and your specific contract, the specific contract takes precedence.
